Yeah, but the kill fee isn't something I'm really concerned with; if it's going to potentially delay our ability to get this sold in September by virtue of however much time it would take to Gregg and his lawyer to get it back, and then whatever other back-and-forth is required, let's just take it out.

OK, here are my replies to your /your lawyers queries. The question of kill fee hasnt been addressed w/ Gregg. Ive inserted language Id be comfortable (in both directions) recommending, including two different fees, depending on the circumstance. This is precisely the sort of instance where it can be argued that Im in a compromised role, a conflict of interests kind of thing, because Im not wholly advocating for you against Gregg. Ive done this on numerous occasions, and what Ive tried to do is find common ground where both parties are comfortable.
So: if you / your lawyer arent comfortable w/ the figures Ive put in there, I have no objection to your suggesting another. Once youve done, THATs when Ill go to Gregg and say, OK, heres a draft that works for Barrett, have your lawyer review it. And then we go back and forth.
So the comments you see here are mine alone, and dont reflect anything Im trying to accomplish on GHs behalf. Does that make sense?
