OK, here are my replies to your /your lawyer’s queries.  The question of “kill fee” hasn’t been addressed w/ Gregg.  I’ve inserted language I’d be comfortable (in both directions) recommending, including two different fees, depending on the circumstance.  Would you ask your lawyer if he’s comfortable with these on your behalf? If so, then I’ll raise the issue with Gregg. 

 

This is precisely the sort of instance where it can be argued that I’m in a compromised role, a conflict of interests kind of thing, because I’m not wholly advocating for you against  Gregg.  I’ve done this on numerous occasions, and what I’ve tried to do is find common ground where both parties are comfortable.

 

So:  if you / your lawyer aren’t comfortable w/ the figures I’ve put in there, I have no objection to your suggesting another.  Once you’ve done, THAT’s when I’ll go to Gregg and say, OK, here’s a draft that works for Barrett, have your lawyer review it.  And then we go back and forth.

 

So the comments you see here are mine alone, and don’t reflect anything I’m trying to accomplish on GH’s behalf.  Does that make sense?
