As for the charges, this is as good of example as any of the U.S.'s spectacular failure to relate to the information age on reasonable, just terms. That Swartz is facing decades in prison for having done what has been rightfully described as akin to downloading too many books from the library would be more shocking if the pattern hadn't already been established with pirating laws. But the closest thing I would compare it to would be the 15-year sentences being faced by some of the Anons arrested yesterday who are being charged with having participated in DDOS attacks against corporate websites in an act of protest. I've been handling the legal defense on that end since the initial raids in January and have arranged for the National Lawyers Guild to represent those who need pro bono assistance in New York and have additionally brought on lawyers to handle those facing charges in the Northern District of California, where 12 of the 16 are likely to be tried. Meanwhile, there have been zero legal consequences for Aaron Barr and the Team Themis crowd for their own digital conspiracy.
