UPDATE #1 10/06/2010





Tyler Investigators have received the official autopsy results on Ava
Faith Ayers, age 2 of Tyler. The results indicated that Ayers died as
a result of water in her lungs an no other signs of foul play were
indicated.  This case was reviewed by the Smith County District
Attorney’s Office to determine if any criminal charges were warranted.
After reviewing the facts of the case, it has been determined the
drowning was accidental and no criminal charges will be pursued.







2 Year Old Drowns at Home in Swimming Pool



At around 2:00 p.m. Officers responded to 3721 Arlington in Tyler in
reference to a 2 year old child drowning in the swimming pool.
Arriving officers learned that a 16 year old was babysitting for a 2
year old and a 3 year old.  The 16 year old was talking to someone
when the 2 year old went out the back door and fell into the pool.
The 2 year old was transported to Trinity Mother Frances Hospital.
She was unable to be revived and was pronounced dead.



The victim has been identified as Ava Faith Ayers W/F Date of birth of
September 20, 2008.  Investigators continue their investigation.
