Gentlemen,

As we have very little information on Vincent Garofalo, we are left with two options.  We can either hire a private investigator to come up with his home address or we can attempt to initiate a 'john doe' suit in New York using the cell phone humber he used when registering his website.  It has been a while since the website was registered and it is possible that the phone records will be very hard to obtain.  Though I am licensed in both New York and Texas, I will not be in New York until July at the earliest. If we decide to go the 'john doe' suit route perhaps Barrett can file the initial paperwork--if he doesn't mind.  From what I've heard it is best to have a county clerk walk you through it and present the possible options based on your particular circumstances and level of information. Of course, both of those options involve some amount of money.  Let me know how you would like to proceed.

He has used an e-mail address associated with the dojo to register one of his websites. I'm assuming that he's still there, am working on trying to find out how to acquire his home address.

I'm afraid I don't have any information about Mr. Garofalo. Barrett, how did you find him at his dojo? Is he still there? Would they have any info on him?

Gentlemen,

I have been unable to find any personal information for Vincent Garofalo. In order to sue Mr. Garofalo, we need to obtain his address, or at least some identifying information that will lead us to his address.  Please let me know of any new facts that may have come to light.  A private investigator is an option as well.

Please advise me on how you would like to proceed.
Thanks.

Mirna,

Thank you very much for your work on this case. I am definitely interested in pursuing this matter, wherever it takes us.

I don't know any New York attorneys, however. I will ask some relatives who are lawyers if they have any suggestions, but short that, I'm willing to follow your advice.

Thanks again Mirna. I hope we are able to resolve this quickly, and in a happy manner for all.

Sincerely,

Ryan Cole

Gentlemen,

As you know, I contacted Vincent Garofalo on Barrett's behalf and he expressed a desire to reach some sort of settlement to avoid litigation.  Since then he has not responded to my messages.  I did not inform him of your claims, Bob and Ryan, as I didn't want to scare him before he gave out a figure.

As he has stopped responding, it is my opinion that at this point we should pursue litigation and sue Garofalo in New York.  Garofalo's previous behavior indicates there is a good chance he'll settle to avoid court .

You three do not have adverse interests, and should sue as co-plaintiffs.  I am a Texas attorney, which allows me to represent Barrett. I will need to team up with a New York attorney in order to represent Bob and Ryan's interests in New York court.

If there is a New York attorney you prefer I contact, or if you are not interested in pursuing the matter further, please let me know.  Otherwise I will contact you with some options and we can decide where to go from there.
