Though I appreciate your prompt response to this matter, several of the points you make in your recent e-mail require some clarification.
You assert that you are unaware of having had contact with my client in the past. It is possible that you have forgotten that my client contacted you in 2006 by way of a writer's protection organization known as WritersWeekly, which is run by Angela Hoy, who e-mailed you and your former editor on my client's behalf; that the information which was forwarded to you contains a full account of his claim; that you responded to the e-mail in question without disputing any of the facts in question; that, instead of making any clarifications with regard to this matter, you chose to instead make allegations about the allegedly poor performance of one of the four writers to whom money is owed; and that, after having asked Hoy to contact Sam Fasani about the matter, you neglected to respond any further. Please let me know if you would like us to direct you to a full account of this incident, which is public record.
With regards to your relationship to Ideacast, I would simply note for now that I would not be taking this case on consignment if I were not already in possession of evidence that clearly contradicts your account.
Despite appearances, my client is a reasonable person and could be convinced to accept a settlement if he found the sum to be agreeable. You mention that, from your standpoint, the amount of any such settlement would have to bear some relation to the potential cost of your defense. This is, of course, understandable, and I would be interested in hearing your offer. But I would ask you to remember that, in addition to the legal fees that you would incur as a result of legal action on our part, any such court case would also entail other difficulties for you, not the least of which would be a greater degree of scrutiny into your general conduct thus far and it is obvious from the manner in which your operations have been arranged that you seek to avoid any such scrutiny. Additionally, your assessment as to how such a case would turn out may be overly optimistic. Bearing all of this in mind, your offer would have to involve a very substantial portion of the money owed, and my client would have to receive it soon.
If we find your offer agreeable, then I will of course instruct my client to sign away any further claims against you.
